Professional Negligence


It will come as no surprise that the people you instruct to provide professional help also do sometime make mistakes. Although we expect more from them, they too are human beings. If you have suffered loss or damage as a result of something which your Professional has done or has failed to do, we would be happy to investigate your claim and represent you. The Professional may be a Solicitor, Doctor, Dentist, Accountant etc.


In determining whether or not the Professional is guilty of negligence, we got a need to establish that the service that you were provided is not one that would have been provided by a reasonably competent Professional. Once this test has been satisfied, you will need to show that the losses and / or damages suffered were caused by that professional negligence. Sometimes it is easier to satisfy the first test and not the second. In many cases, it would be necessary to instruct another Professional in the same fraternity to advise on the standard of service received by you. That evidence is very important.


The Courts encourage early resolution of the disputes involving Professionals. It would be advisable to firstly explore the possibility of mediation. If this is not considered, the Court have power to deprive the winning party of costs. There could also be further consequences. We would be happy to discuss these with you.


The Court Rules have laid down certain steps that have to be followed in professional negligence claims. These are known as Practice Directions. These must be followed before proceedings can be issued. We would be happy to discuss these with you.
